Terms of Service for Scarabeus

These Terms are offered by Denis Gennadievich Bookreev, taxpayer under the Russian professional income tax (self-employed) regime, referred to as the Provider. By creating an account, connecting a Telegram bot, connecting a chat, enabling paid features or paying for the service, the user accepts these Terms.
1. Definitions
Service means the Scarabeus web dashboard, Telegram bots and software modules that help Telegram chat administrators configure automated moderation, view logs, manage rules, appeals, tariffs and paid features.
User means an individual using the Service.
Chat Administrator means a User who has management rights in a Telegram chat and connects the Service to that chat.
Paid Features means tariffs, subscriptions, add-on modules, AI moderation, prepaid balance and other paid functionality.
Limited tariff means the default chat state with limits on some features.
Base tariff means the paid chat tariff with full access to moderation features.
Trial access means temporary full access for a chat after it is connected.
AI moderation means a paid feature with a prepaid balance, separate from the chat tariff.
2. Subject of the agreement
The Provider gives the User access to the Service for configuring and using Telegram chat moderation tools. The available functionality depends on the selected tariff, chat settings, available balance and Telegram technical limits.
The Service does not provide legal, financial, employment or other professional advice. The User is responsible for moderation rules, sanctions, message texts and chat settings.
3. Account access
Telegram is used to access the Service. The Service may receive the User's Telegram identifier, username, first name, last name, interface language and other data required for login and dashboard operation.
The User must protect their Telegram account and must not share dashboard access with unauthorized third parties. Actions made through the User's account are treated as actions made by the User.
4. Connecting Telegram bots and chats
If the User connects their own Telegram bot, the User confirms that they are authorized to use that bot and provide its token to the Service. The Service uses the token only to provide bot connection, verification, moderation and chat service functionality.
The User is responsible for ensuring that connecting the Service to a chat, configuring moderation rules and processing messages complies with Telegram rules, applicable law and the internal rules of the relevant chat or organization.
5. Moderation and automated actions
The Service may automatically check messages, media, chat members and chat events, and may apply actions configured by the User, including message deletion, warnings, restrictions, bans, manual review and other available actions.
The User understands that automated moderation may be inaccurate. The User must review moderation rules, sanctions and exemptions, especially where they may materially affect chat members.
6. AI moderation
If the User enables AI moderation, messages, media captions and attachments, if media processing is enabled, may be sent to external LLM providers for automated analysis. The Service uses the result of this analysis for logs, manual review queues or sanctions according to the User's settings.
AI moderation may be delayed, inaccurate or temporarily unavailable. The User is responsible for enabling this feature and choosing how the results are handled.
7. Tariffs, payments and balance
Current service descriptions, tariffs and paid features are published at https://scarabe.us/pricing. Payments are processed through payment partners.
Available products:
- Limited tariff — default chat state with feature limits;
- Base tariff — full access to chat moderation features;
- Trial access — temporary full access for a chat;
- AI moderation — prepaid balance, separate from the chat tariff.
The price of the Base tariff is determined by the published activity-level pricing grid: after the trial period the chat is assigned a level, and payment follows that level's price. Current levels and prices are published on the pricing page: https://scarabe.us/pricing. The exact price is shown in the dashboard after login and calculation for the specific chat. Payment is made only after the amount is shown to the User.
The User always sees the final price before proceeding to payment. Payment means that the User accepts the displayed price and the terms of the selected paid feature.
Paid features become available after successful payment or manual activation by the Provider. If a paid feature depends on a paid period, access ends or becomes limited after the paid period expires.
AI moderation uses a prepaid balance. When messages are processed, the balance is reduced by the cost of external LLM provider usage with the Service's applicable markup or tariff. If the balance is depleted, AI moderation may stop until the balance is topped up.
Services are provided to individuals.
A tariff-based service is considered provided from the moment the User receives access to the relevant paid feature for the paid period. AI moderation is considered provided when a message is processed and the corresponding amount is deducted from the prepaid balance. Trial access is provided free of charge and does not create a payment obligation.
The Provider applies the Russian professional income tax regime. VAT is not charged. After payment, the User receives a receipt in the manner required by applicable law.
8. Refunds
Paid amounts are non-refundable, except where a refund is required by law or the payment was technically mistaken. Unused subscription time, unused AI balance and services already provided are non-refundable unless otherwise required by law.
Technically mistaken payments (duplicate charge, access activation failure or another clear technical error) are reviewed after contacting support@scarabe.us.
9. Restrictions
The User must not use the Service for unlawful personal data processing, spam, abuse of Telegram limits, infringement of third-party rights, distribution of harmful content or any unlawful purpose.
The Provider may limit access to the Service if the User violates these Terms, abuses the Service, creates a security risk, fails to pay, if technical reasons require it, or if required by law.
10. Personal data
Personal data processing is described in the Privacy Policy: https://scarabe.us/legal/privacy. By accepting these Terms, the User confirms that they have reviewed the Privacy Policy.
11. Liability
The Service is provided "as is", subject to planned and unplanned interruptions, Telegram limitations, payment partner limitations, hosting limitations and external provider limitations. The Provider does not guarantee uninterrupted operation, error-free operation or any specific moderation result.
The Provider is not liable for losses caused by the User's incorrect settings, Telegram actions, external providers, payment systems, chat administrators or chat members.
12. Governing law and disputes
These Terms are governed by the laws of the Russian Federation.
Disputes are resolved through negotiations and by contacting support at support@scarabe.us. If no agreement is reached, the dispute is subject to court review under the procedure established by the laws of the Russian Federation, with due regard for consumer rights.
13. Changes
The Provider may change these Terms, tariffs and available functionality. The new version is published on the website and applies from publication unless stated otherwise. If a change requires renewed consent, the Service may request consent at the next login or before using the relevant feature.
